حددت تعديلات قانون الجنسية المصرية التي صدرت مؤخرا من مجلس النواب شروط حصول الزوجة الأجنبية على الجنسية المصرية وحالات فقدانها لها .
ونص القانون على أنه «لا يترتب على اكتساب الأجنبى الجنسية المصرية اكتساب زوجته إياها، إلا إذا أعلنت وزير الداخلية برغبتها في ذلك ولم تنته الزوجية قبل انقضاء سنتين من تاريخ الإعلان لغير وفاة الزوج. ويجوز لوزير الداخلية بقرار مسبب قبل فوات مدة السنتين، حرمان الزوجة من اكتساب الجنسية المصرية.
أما أولاده القصر، وكذلك أولاد الأجنبية القصر التي اكتسبت الجنسية المصرية فيكتسبون الجنسية المصرية، إلا إذا كانت إقامتهم العادية في الخارج وبقيت لهم جنسية أبيهم أو أمهم الأصلية طبقًا لقانونها، فإذا اكتسبوا الجنسية المصرية كان لهم خلال السنة التالية لبلوغهم سن الرشد أن يقرروا اختيار جنسيتهم الأصلية، فتزول عنهم الجنسية المصرية متى استردوا جنسية أبيهم أو أمهم طبقًا لقانونها
ونصت المادة على أن «لا تكتسب الأجنبية التي تتزوج من مصرى جنسيته بالزواج إلا إذا أعلنت وزير الداخلية برغبتها في ذلك ولم تنته الزوجية قبل انقضاء سنتين من تاريخ الإعلان لغير وفاة الزوج، ويجوز لوزير الداخلية بقرار مسبب قبل فوات مدة السنتين حرمان الزوجة من اكتساب الجنسية المصرية».
وإذا اكتسبت الأجنبية الجنسية المصرية طبقا لأحكام المادتين السابقتين فلا تفقدها عند انتهاء الزوجية إلا إذا استردت جنسيتها الأجنبية أو تزوجت من أجنبى ودخلت في جنسيته طبقا لقانون هذه الجنسية.
The amendments to the Egyptian Nationality Law recently issued by the House of Representatives specified the conditions for a foreign wife to obtain Egyptian nationality and the cases of her losing it.
The law stipulates that “the acquisition of Egyptian nationality by a foreigner does not result in his wife acquiring it, unless she announces to the Minister of the Interior her desire to do so and the marriage does not end before the expiry of two years from the date of the announcement, other than the death of the husband.” The Minister of Interior may, by a reasoned decision before the expiry of the two-year period, deprive the wife of acquiring Egyptian nationality.
As for his minor children, as well as the minor children of a foreign woman who has acquired Egyptian nationality, they acquire Egyptian nationality, unless their regular residence is abroad and their father or mother’s original nationality remains in accordance with its law. If they acquire Egyptian nationality, they may, during the year following their attainment of majority, decide to choose their original nationality. The Egyptian nationality is lost from them when they regain the nationality of their father or mother in accordance with its law
The article stipulates that “a foreigner who marries an Egyptian man shall not acquire his nationality through marriage unless she declares her desire to do so to the Minister of Interior and the marriage has not ended before two years from the date of the announcement, other than the death of the husband. The Minister of Interior may, by a reasoned decision before the expiry of the two-year period, deprive the wife of acquiring Egyptian nationality.” ».
If a foreigner acquires Egyptian nationality in accordance with the provisions of the previous two articles, she shall not lose it upon the termination of marriage unless she regains her foreign nationality or marries a foreigner and assumes his nationality in accordance with the law of this nationality.
